Engineering Fitness International Corporation, doing business as efi Sports Medicine (EFI) is the sole owner of the information collected on its family of websites, totalgym.com, totalgymworkout.com, efisportsmedicine.com, gravityclubhouse.com, cyclotrainer.com and gravitystories.com and other websites now in development or reserved for future development (Sites). EFI holds the privacy of our visitors and customers in deep respect and confidence. In an effort to serve our customers needs and desires through our web services and products, EFI collects Personally Identifiable Information from our users at several different points on our Sites.


The privacy practices of this statement apply to our services available under the domains and subdomains of EFI. By visiting this or any or our Sites you agree to be bound by the terms and conditions of this Privacy Statement. If you do not agree please do not use or access our Sites. As this Statement may be modified from time-to-time, you should check this Privacy Statement frequently for any such changes. Your continued access or use of our Sites shall constitute acceptance of any modifications of the Privacy Statement. Our use of information gathered or obtained at any time is subject to the Privacy Statement in effect at the time of such use.

This Privacy Statement describes the information, as part of the normal operation of our services, we collect from you and what may happen to that information. We have prepared a detailed Statement because we believe you should know as much as possible about our practices so that you can make informed decisions. By accepting the Terms of Use, visiting any of our Sites, shopping on any of our Sites, completing our surveys, participating in our sweepstakes or other incentives, responding to our e-mails, or otherwise interacting with EFI, you are consenting to EFI practices, including the use and disclosure of any Personally Identifiable Information you have shared with us, as described in this Privacy Statement. Finally, please note that this Statement applies only to EFI family of Sites and not to other companies' or organizations' Web sites to which we link.

INFORMATION COLLECTION & USE

Orders
If you purchase a product or service from us, we request certain Personally Identifiable Information from you on our order form. You must provide contact information (such as name, email, and billing address, shipping address, telephone number, …etc.) and financial information (such as credit card number, CVV code, expiration date).

We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you. Upon completion of online ordering, you will receive a confirmation notice via email, and you may receive an invoice containing your order information, upon request. We do not include personally sensitive data such as Credit Card numbers in these order confirmation emails. During the ordering process on our Sites, we utilize a secure transmission encryption software to protect your Personally Identifiable Information. Please see Security section of this Statement.

We use this information to send EFI related email transmissions to you for marketing purposes, to mail directly to your physical address and for internal telemarketing, customer surveys, etc.

EFI will not sell or share your Personally Identifiable Information except where required to by law.

Financing
We utilize Monterey Financial Services for customers who choose the multi-payment options. We provide Monterey Financial access to your Personally Identifiable Information including sensitive data such as credit card number, etc., so they can fulfill their financing services on multi-pay options. We reserve the right to change our financing service provider without notice to customers.

Surveys and Contests
From time-to-time we may provide you the opportunity to participate in contests or surveys on our Sites. If you participate, we will request certain Personally Identifiable Information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code). We may also ask for other Personally Identifiable Information to assure the accuracy of survey results. For instance, we may require certain fields to be completed, such as gender, age, ownership of product categories, income, etc.

We may use this information to notify contest winners and award prizes, to monitor Sites traffic or personalize Sites (in the case of anonymous information collected in surveys), to send participants email newsletters or learn about the demographics of users and customers to provide better support and products.

We may use a third party service provider to conduct these surveys or contests; such third party service providers are prohibited from using our users’ Personally Identifiable Information for any other purpose than the purpose for which EFI contracted their services. EFI will not share the Personally Identifiable Information you provide through a contest or survey with other third parties except where required by law. In the event that EFI feels it is in your interest for us to share your information, we will give you opt-in choice.

Email to a Friend
If you choose to use our referral service to tell a friend about our Sites, we will ask you for your friend’s name and email address. EFI does not store this information except for the sole purpose of sending this one-time email.

Uses of Information
We receive and store any information you provide to us when you complete surveys, request additional information from us, participate in a sweepstakes or other incentives, make purchases online, set up accounts, sign up to receive our newsletters or other e-mail communications, communicate by e-mail, telephone or physical mail with our customer service, or otherwise interact with us. Such information may include your name, address, e-mail address, shopping interests and preferences, transaction history, and other personal data ("Personal Information"). We collect Personal Information that is reasonably necessary to comply with your requests and with our legitimate business interests. You can choose not to provide certain information, but then you might not be able to participate in our surveys or incentives, purchase products, or take advantage of certain useful Sites features. We use this information to provide support to you, notify you of any important updates regarding any product you have may have purchased from us, notify you of special incentives or offers, announce new products and create demographic reports to better understand your needs and desires with our products so that we may enhance your customer experience. EFI does not share any of this information with third parties except where outlined in other areas of this Statement, i.e., financial service providers, required by law.

Printed Material
EFI stores printed copies of invoices and orders in secure locations and adheres to policies that are designed to protect your personal information. Secure off-site facilities are used to archive stored information.

Destroying Printed Material
Should there be a need to destroy forms, sales orders, invoices and the like, that contain Personally Identifiable Information, EFI shreds the documents and uses a secure third party supplier to transport the shredded material to a destination where the material is destroyed.

Live Chat
The Live Chat service does collect non-Personally Identifiable Information such as location, referred page, IP address and visited pages to the website. It also allows EFI employees with authorization to contact you via the website to assist you with any questions or needs you may have. This information is not stored nor is it connected to any Personally Identifiable Information. You have the option to decline Live Chats at anytime. Through the Live Chat application, authorized personnel can watch your activity on our Sites.

COMMUNICATIONS FROM THE SITES

Special Offers and Updates
We will occasionally send you information on products, services, special deals, promotions and the like. You can sign up for these emails from us on our registration page.

Out of respect for your privacy, we present the option not to receive these types of communications. You may select “Choice and Opt-out” to choose not to receive communication from EFI or our Sites.

Service-related Announcements
We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if there is a defective part that needs to be replaced we might send you an email or letter so we can replace your part.

Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account. This can be done by contacting Customer Service department.

Customer Service
We will communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by mail, email or telephone, in accordance with your wishes.

Profile
We store information that we collect through cookies, log files, clear gifs, [and/or third party sources] to create a “profile” of your preferences. We tie your Personally Identifiable Information, and [or] your purchasing history, to information in the profile, in order to provide tailored promotions and marketing offers and to improve the content of the site for you.

We do not share your profile with third parties except as required by law.

A SPECIAL NOTE ABOUT CHILDREN

Our Sites are not designed or intended for use by children under 13 and comply with the provisions of the Children's On-Line Privacy Protection Act. If you are under 18, you should use our Sites only with involvement of a parent or guardian. Children under 13 may not submit any Personally Identifiable Information to us, and if we discover that we have inadvertently gathered any such information from a child under 13, we will take appropriate steps to delete it.

INFORMATION SHARING AND DISCLOSURE

Aggregate Information (non-personally identifiable)
We share aggregated demographic information about our user base with only one partner, American Telecast Corporation. This information does not identify individual users. Partner in the scenario consists of our relationship with American Telecast who delivers the Infomercial model Total Gym to consumer customers. We may share information on our demographics to understand how we can better deliver the information of our products to our customers.

We do not link aggregate user data with Personally Identifiable Information.

Personally identifiable information
We DO NOT share Personally Identifiable Information with third parties other than those listed in this Statement, or where required by law. EFI does not sell your Personally Identifiable Information. Our data base and all collected information is confidential to our business.

Legal Disclaimer
We reserve the right to disclose your Personally Identifiable Information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court-order, or legal process served on our Sites.

Choice/Opt-out
We provide you the opportunity to ‘opt-out’ of having your Personally Identifiable Information used for certain purposes, when we ask for this information. For example, if you purchase a product/service but do not wish to receive any additional marketing material from us, you can indicate your preference on your order form.

If you place an order for product, your Personally Identifiable information is stored in two databases. One is used for marketing and tracking purposes, one is an accounting program that tracks your order and payment history. Should we need to contact you with critical information about your product purchase, we will use the accounting program database. You do not have the choice to opt out of notifications coming from this database. EFI makes every effort to ensure that the accounting database is used only for product notifications critical to your specific purchase.
You will be notified when your Personally Identifiable Information is collected by any third party that is not our agent or service provider, so you can make an informed choice as to whether or not to share your information with that party.

Log Files
As is true of most Web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole.

We do not link this automatically-collected data to Personally Identifiable Information.

We use our tracking service which is based off of Log files in conjunction with a third-party tracking service called “Google Analytics” that uses cookies to track non-Personally Identifiable Information about visitors to our site in the aggregate usage and volume statistics to understand our visitors to help enhance their customer experience using our websites.

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on our Sites. We do not link the information we store in cookies to any Personally Identifiable Information you submit while on our site.

Clear Gifs (Web Beacons/Web Bugs)
We employ, or our third party advertising partners employ, a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our customers’ Personally Identifiable Information.

We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients.
